1. Purpose

These terms and conditions of sale (hereinafter the "T&Cs") apply to all orders placed by any consumer or non-professional customer (hereinafter the "Customer(s)") via the website sideraparis.com (hereinafter the "Site") for one or more ready-to-wear products and accessories (hereinafter the "Products") marketed by SAS SIGNS, a company with share capital of 1,000 euros, whose registered office is at 28 rue Galilée, 75016 PARIS, registered with the Paris Trade and Companies Register under number 989 377 726 (hereinafter the "Seller").

The T&Cs are drafted in the French language. Any translation is provided for information purposes only. In the event of any contradiction or divergence of interpretation between the French version and a translated version, the French version shall prevail in all its provisions and shall be the sole authoritative version.

2. Availability and updates of the T&Cs

The T&Cs are made available to the Customer on the Site.

Prior to placing any order, the Customer acknowledges having read the T&Cs and having accepted them by ticking the box provided for this purpose. Validation of the order constitutes acceptance of the T&Cs in force on the date of the order.

The Customer declares that they have the legal capacity to contract, that is to say that they are aged 18 or over and are not placed under guardianship.

The Site is intended exclusively for sales to consumers or non-professionals. By placing an order on the Site, the Customer represents and warrants that they are acting for personal, non-commercial purposes, without any intention of reselling the Products for commercial purposes. The purchase of Products via the Site with a view to resale is prohibited. Accordingly, the Seller reserves the right to refuse any order of an abnormal character.

The Seller reserves the right to revise or amend the T&Cs at any time and without prior notice. The applicable T&Cs are those in force on the date of the order.

3. Products

Each of the Products marketed on the Site is the subject of a description setting out its essential characteristics.

The Seller makes all reasonable efforts to display the Products accurately, including their colours. However, the actual colour you see will depend on the configuration of your system and the Seller cannot guarantee that your computer will correctly display these colours. The photographs illustrating the products do not constitute a contractual document.

Given the limited nature of certain collections, the Products may be sold out without prior notice. Consequently, all orders are subject to the availability of the Products.

4. Orders

4.1 Ordering process

To place an order, the Customer must select the Products of their choice, in the desired quantity, and click on "Add to basket". This action adds the Product to the Customer's "Basket".

The Customer may:

  • Obtain a summary of the Products they have selected or modify their order by clicking on the "Basket" icon accessible at the top right of each page;
  • Continue their selection of Products;
  • Complete their selection of Products and proceed to the ordering process by clicking on "My Basket" and then "Complete order".

The Customer will be taken directly to the next step and will be prompted to log in to their customer account or to complete the information necessary for their identification, in particular their surname and first name, postal address, telephone number, etc.

Subsequently, based on the delivery address provided, the Customer will be shown the shipping method(s) offered together with the corresponding delivery charges.

The Customer will then be prompted to enter the information relating to the method of payment (bank card or Apple Pay).

The Customer will have the option to save all of their information for future purchases.

Before clicking on the "Confirm" button, the Customer has the opportunity to check the details of their order and its total price and to correct any errors or possibly modify their order, and must confirm having read and accepted the T&Cs by ticking the box provided "I have read and I accept the terms and conditions of sale and the privacy policy".

The information provided by the Customer when placing the order is binding on the Customer. Once the order has been placed, the Customer may not change the said information. In the event of an error in the wording of the recipient's contact details, the Seller cannot be held liable for any inability to deliver the Product.

When the Customer places an order, they receive confirmation of the order and of payment by email.

All orders are processed within one to three business days (Monday to Friday, excluding French public holidays). Orders placed at weekends or on public holidays will only be processed from the following business day.

The Seller reserves the right to refuse or cancel any order in the event of legitimate suspicion of fraud, of a manifest pricing error, in particular where the displayed price is manifestly derisory or inconsistent with the actual value of the Product, or in the event of an inability to fulfil the order, in particular due to the unavailability of the Product.

In the event of cancellation of the order for any of the reasons set out above, the Seller shall immediately inform the Customer by email and any sums paid shall be refunded as soon as possible using the same means of payment as that used for the order. If, for any reason, this is not possible, the Seller shall contact the Customer to arrange the refund.

4.2 Use of promotional codes

Promotional codes may be used during the ordering process, subject to compliance with the conditions applicable to the relevant offer.

Unless expressly stated otherwise, only one promotional code may be used per order. Promotional codes may not be combined with one another or with any other current offers or promotions.

Each promotional code is valid only during the period indicated and for the Products or categories of Products expressly covered by the corresponding offer.

4.3 Use of gift cards

Gift cards are valid for a period of twelve (12) months from their date of purchase.

They may be used in one or more instalments, to pay all or part of an order, up to the limit of their face value.

Gift cards may not be refunded, nor exchanged for their cash value.

The Customer is responsible for the safekeeping and use of their gift card. Save for fault attributable to the Seller, the loss, theft, deterioration or fraudulent use of a gift card shall not give rise to any replacement or refund.

5. Delivery

We ship only to addresses located in Europe and the United States.

Once the order is ready to be shipped, the Customer will receive shipping and tracking information by email.

5.1 Indicative delivery times

Orders are shipped through recognised carriers, such as DHL, Chronopost, Colissimo or any other equivalent service, selected according to the destination and the delivery method chosen by the Customer.

For each Product, the estimated delivery time is:

  • 2 to 4 business days for any order to France;
  • 3 to 7 business days for any order to a European country (excluding France);
  • 5 to 10 business days for any order to the United States.

By way of exception, express delivery, within an estimated timeframe of 1 to 3 business days, may be offered for certain European destinations. Where this option is available, it will appear during the ordering process.

The delivery times indicated are estimates calculated from the date of dispatch of the order. They may vary depending on the destination, the delivery method chosen and the operational constraints of the carriers. The Seller cannot be held liable for delivery delays resulting from customs formalities, disruptions affecting transport services, or any other event beyond its control.

If the order is delivered damaged or if it is not delivered within the estimated timeframe indicated at the time of the order, the Customer is invited to contact the Seller as soon as possible at the following address: hello@sideraparis.com, specifying their order number. The Seller will liaise with the carrier in order to identify the origin of the incident and to seek a solution as soon as possible.

5.2 Delivery charges

The delivery charges applicable to the order are indicated to the Customer before the final validation of the order.

Standard delivery is complimentary for any order in an amount greater than €200 inc. VAT, regardless of destination.

For orders whose amount is below this threshold, the delivery charges are calculated at the time of the order based on the delivery destination and the weight of the parcel. The applicable amount is indicated to the Customer before the validation of their order.

5.3 Taxes and customs duties

For orders shipped within the European Union, prices are stated inclusive of all taxes (inc. VAT), including applicable VAT, and no additional tax or customs duty is payable on delivery.

For orders shipped outside the European Union, in particular to the United States, customs duties, import taxes, clearance fees or other local taxes may be levied by the competent authorities of the country of destination. Such charges remain the sole responsibility of the Customer and are not included in the price of the Products nor in the delivery charges invoiced by the Seller.

The Seller has no control over such charges and is not in a position to determine the amount thereof in advance. It is the responsibility of the Customer to enquire, prior to placing any order, with the competent customs or tax authorities of their country of destination regarding the taxes, duties and charges that may apply to the importation of the Products.

6. Prices and payment terms

6.1 Prices

The prices of the Products indicated on the Site are displayed in euros, inclusive of all taxes (inc. VAT), including applicable VAT.

The applicable delivery charges are indicated to the Customer during the ordering process, before the final validation of the order.

For orders whose delivery address is located outside the European Union, in particular in the United States, VAT may be deducted automatically during the ordering process. Where applicable, local taxes, customs duties, import fees or other charges payable in the country of destination remain the sole responsibility of the Customer.

Where prices are displayed in US dollars (USD), such prices are displayed for information purposes only. The authoritative transaction currency is the euro (EUR). Any conversion rates, banking fees or commissions applied by the Customer's bank or card issuer may result in variations in the amount actually debited.

The Seller reserves the right to modify its prices at any time. However, the price applicable to the order is that confirmed to the Customer at the time of the final validation of the order.

6.2 Payment terms

Payment is made immediately, online, upon placing the order. Notwithstanding the application of Article R. 642-3 of the French Criminal Code, the Customer shall pay for their order by bank card, Apple Pay via Shopify Payments or Klarna.

The Site is equipped with an online payment security system enabling the Customer to encrypt the transmission of their banking data via the electronic payment server of the secure payment platform (SSL). At no time will the Customer's banking data pass through the Seller's computer system.

The online provision of the bank card number or of any other means of payment and the final validation of the order shall constitute proof of the entire order, in accordance with the provisions of Law no. 2000-230 of 13 March 2000 adapting the law of evidence to information technologies and relating to electronic signatures, as reproduced in Articles 1365 and 1366 of the French Civil Code. They shall also constitute enforceability of the sums incurred by the entry of the items appearing on the order form.

The order validated by the Customer shall not be considered effective until the relevant bank payment centre has given its approval. In the event of refusal by said centre, the order will be automatically cancelled and the Customer will be informed by notification on the order validation page of the failure of the order.

7. Right of withdrawal and exchanges

In accordance with Articles L. 221-18 et seq. of the Code de la consommation, the Customer has a period of fourteen (14) days from the date of receipt of their order to exercise their right of withdrawal.

Where the order relates to several Products delivered separately, the withdrawal period expires fourteen (14) days after the day on which the Customer takes possession of the last Product.

To exercise their right of withdrawal, the Customer must notify the Seller of their decision to withdraw, before the expiry of the aforementioned period, by email to the following address: hello@sideraparis.com. The Customer may use the model withdrawal form below.

After notifying their decision to withdraw, the Customer must return the Products to the Seller, at the following address: 28 rue Galilée, 75016 Paris, without undue delay and no later than within a period of fourteen (14) days from such notification.

Save in the case of a defective or incorrect Product, the return costs are borne by the Customer. Returned Products travel at the Customer's risk, and the Customer is invited to retain any proof of dispatch.

The Products must be returned in their original condition, unworn, unwashed, unaltered, with their tags, plaques, accessories and, insofar as possible, their original packaging. Accordingly, Products showing signs of wear, damage, soiling, washing, alteration or modification cannot be returned and shall not give rise to any refund.

Likewise, for reasons of hygiene, jewellery delivered in sealed packaging cannot be returned after opening, in accordance with the provisions of Article L. 221-28 of the Code de la consommation.

In the event of valid exercise of the right of withdrawal, the Seller shall refund the Customer in accordance with Article L. 221-24 of the Code de la consommation, using the same means of payment as that used for the order, unless expressly agreed otherwise. The refund shall be made within fourteen (14) days following receipt of the returned Products.

The delivery charges initially paid by the Customer are not refunded.

The Seller does not carry out direct exchanges. A Customer wishing to obtain a different size, model or style is invited to return the Product concerned under the conditions provided for above and to place a new order.

8. Archiving and evidence

In accordance with Article L. 213-1 of the Code de la consommation, the Seller undertakes to retain and archive on any medium, for a period of ten (10) years, all documents relating to contracts concluded between the Customer and the Seller (in particular communications, order forms and invoices) with a value greater than or equal to €120, and to guarantee access thereto by the Customer at any time.

Such communications, order forms and invoices may be produced as evidence of the contract.

9. Warranties

All Products for sale on the Site benefit from the legal warranty of conformity (as defined in Articles L. 217-4 et seq. of the Code de la consommation) and from the warranty against latent defects (as defined in Articles 1641 et seq. of the French Civil Code), allowing the Customer to return, free of charge, Products delivered defective or non-conforming, provided that they have been used normally.

In accordance with Article D. 211-2 of the Code de la consommation, information on the arrangements for implementing the legal warranties is available on request at hello@sideraparis.com.

10. Liability

The Seller cannot be held liable for damages caused by improper use of the Products sold on its Site or by failure to comply with the precautions of use.

In addition, the Seller is not liable for losses due to an event beyond its reasonable control, including, but not limited to: fires, floods, storms, riots, civil unrest, pandemics, war, nuclear accidents and terrorist activities.

11. Intellectual property

All the elements appearing on the Site, in particular texts, photographs, images, illustrations, videos, logos, trademarks, trade names, corporate names, creations, drawings, designs, graphics, graphic charters, visual identity elements, as well as the general structure of the Site and its contents, are protected by intellectual property rights or other proprietary rights and are the exclusive property of SAS SIGNS.

These elements are protected by French and international intellectual property law, in particular by copyright, trademark law and, where applicable, the law of designs and models.

Any reproduction, representation, distribution, adaptation, modification, extraction, reuse, exploitation or use, in whole or in part, of these elements, on any medium whatsoever and by any means whatsoever, without the prior written authorisation of SAS SIGNS, is strictly prohibited.

Any unauthorised use of the Site or of any of its elements is liable to constitute an infringement and to engage the civil and/or criminal liability of its author.

The purchase of a Product on the Site does not confer on the Customer any intellectual property rights in the elements, contents, trademarks or creations of SAS SIGNS.

12. Processing of personal data

The processing of personal data collected via the site sideraparis.com is carried out by SAS SIGNS, in accordance with Regulation (EU) 2016/679 of 27 April 2016, known as the GDPR, as well as the French Data Protection Act (loi Informatique et Libertés).

The Customer may exercise their rights relating to their personal data by contacting SAS SIGNS at the following address: hello@sideraparis.com. The Customer also has the right to lodge a complaint with the CNIL.

13. General provisions

13.1 Invalidity

The invalidity of a contractual clause does not automatically entail the invalidity of the T&Cs, unless such clause is essential or determining for the agreement between the Parties.

13.2 Non-waiver

The temporary or permanent non-application of one or more clauses of the T&Cs shall not constitute a waiver of the other clauses of the T&Cs, which continue to produce their effects.

14. Governing law and dispute resolution

The T&Cs are governed by French law.

In the event of a dispute, the Customer must first contact the Seller's customer service at the following address hello@sideraparis.com in order to attempt to resolve the dispute informally.

If the Customer has previously submitted a complaint to the Seller's customer service and it has not been satisfactorily resolved, the Customer may, in accordance with Articles L.611 to L.616 and R.612 to R.616 of the Code de la consommation, refer the matter free of charge to the consumer mediator to which the Seller is affiliated, namely AME CONSO.

The referral to the consumer mediator must be made:

  • Either by completing the form provided for this purpose on the AME CONSO website: www.mediationconso-ame.com;
  • Or by letter addressed to AME CONSO, 197 Boulevard Saint-Germain – 75007 Paris.

After the failure of an attempt at amicable resolution, the Customer may refer the matter to the Court of their place of domicile.
